What are my options to changing a Temporary Custody Agreement?
My ex-husband and I have a temporary custody agreement that states that we are to each have them 182.5 nights a year yet he hasn’t fulfilled his parenting time for the past 2 years. We are also in disagreement about which school our children should go to next year. I am fed up with it all and want to change the custody agreement. What is the best option(s) for me and/or should I ask for sole custody?
First, get an attorney – legal aid if you are low income – and then file for the primary custody with only visitation for him and at the same time file for Child Support paid through the Friend of the Court. It sounds like he wanted the split custody to avoid paying the child support but since he hasn’t been doing that you should have no problem getting the primary custody. By getting the child support paid through the Friend of the Court you won’t need to worry about him not paying it because they will get it from him one way or the other. Once you have the primary custody it will be your decision where the children go to school.
